Intellectual Property

All content on watersticks.com, including but not limited to text, graphics, logos, product names, product designs, images, photographs, videos, downloads, manuals, specifications, software, and website design, is the exclusive property of WaterSticks Inc. or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

No content may be copied, reproduced, distributed, modified, republished, displayed, transmitted, or used for commercial purposes without prior written permission from WaterSticks Inc.

Unauthorized use of our intellectual property may violate copyright, trademark, and other applicable laws.

California Privacy Rights (CCPA/CPRA)

Performance shall be suspended only for the duration of the event preventing performance.

User Accounts

Customers are responsible for maintaining the confidentiality of their account credentials.

You agree to notify WaterSticks immediately of any unauthorized use of your account.

WaterSticks is not liable for losses resulting from unauthorized account access caused by your failure to safeguard login credentials.

Acceptable Website Use

You agree not to:

• Violate any applicable law.

• Interfere with website operation.

• Attempt unauthorized access to systems or customer information.

• Upload malicious software.

• Scrape or harvest website data without written permission.

• Use automated bots that impair website performance.

Violations may result in termination of access and legal action.

Arbitration & Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY.

To the fullest extent permitted by applicable law, any dispute, claim, or controversy arising out of or relating to these Terms, your purchase of products, or your use of the website shall be resolved through binding individual arbitration rather than in court, except where prohibited by law.

The arbitration shall be conducted under the applicable consumer arbitration rules of the American Arbitration Association (AAA), unless another mutually agreed arbitration provider is selected.

You and WaterSticks agree that:

• Arbitration will be conducted on an individual basis only.

• Neither party may participate in a class action, class arbitration, consolidated proceeding, or representative action.

• The arbitrator may award the same remedies available in court on an individual basis.

• Judgment on the arbitration award may be entered in any court having jurisdiction.

Nothing in this section prevents either party from seeking temporary injunctive relief or pursuing claims in small claims court where permitted by law.

If a court determines that this class action waiver is unenforceable, only that portion shall be severed, and the remainder of this arbitration provision shall remain in effect.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms & Conditions, together with our Privacy Policy, Sales & Use Tax Policy, Warranty Policy, Return Policy, Shipping Policy, and any additional policies posted on our website, constitute the entire agreement between WaterSticks Inc. and the customer regarding the use of our website and purchase of our products.
