Welcome to WaterSticks Inc. (“WaterSticks,” “we,” “our,” or “us”). By accessing or using watersticks.com, placing an order, or purchasing our products, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use this website.
Product Information
We strive to ensure all product descriptions, pricing, specifications, and availability are accurate. However, errors may occasionally occur. WaterSticks reserves the right to correct errors, update information, modify pricing, or discontinue products without prior notice.
Orders
All orders are subject to acceptance and availability.
We reserve the right to:
Refuse or cancel any order.
Limit quantities purchased.
Request additional verification before accepting an order.
Cancel orders due to pricing, inventory, or technical errors.
Shipping
Shipping estimates are provided for convenience only and are not guaranteed.
WaterSticks is not responsible for shipping carrier delays caused by:
Weather
Customs inspections
Carrier disruptions
Natural disasters
Labor disputes
Other circumstances beyond our control
Risk of loss transfers to the purchaser once the shipment has been delivered to the carrier.
Freight Forwarder Policy
To protect our customers and minimize shipping-related disputes, WaterSticks has adopted the following Freight Forwarder Policy.
A freight forwarder is any third-party company or individual who receives products on behalf of the purchaser and then reships those products to another location or country.
When a customer chooses to use a freight forwarding service:
WaterSticks’ responsibility ends once the shipment has been delivered to the freight forwarder’s address and confirmed by the shipping carrier.
The freight forwarder is considered the customer’s designated receiving agent.
WaterSticks is not responsible for loss, theft, damage, delays, missing items, customs issues, repackaging, mishandling, or shipping errors that occur after delivery to the freight forwarder.
WaterSticks cannot replace or refund products damaged or lost after delivery to a freight forwarding company.
Warranty coverage applies only to manufacturing defects and does not cover damage occurring during international forwarding or secondary shipment.
Customers assume all risks associated with using freight forwarding services.
Returns & Warranty
Please refer to our Warranty and Return Policy for eligibility requirements and procedures.
Products that have been modified, improperly installed, frozen, misused, abused, or damaged through improper handling are not covered under warranty.
Limitation of Liability
To the maximum extent permitted by law:
WaterSticks shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from the purchase, installation, or use of any product.
Our maximum liability shall never exceed the purchase price paid for the applicable product.
DISCLAIMER OF LIABILITY
WaterSticks products are designed for use as described in the product documentation.
Improper installation, misuse, excessive water pressure, freezing temperatures, improper maintenance, alteration of products, or failure to follow installation instructions may result in equipment failure.
WaterSticks is not responsible for:
Water damage
Property damage
Personal injury
Loss of business
Loss of profits
Plumbing costs
Installation costs
Removal costs
Labor charges
Consequential damages
Installation should be performed in accordance with all applicable plumbing codes.
Users assume all risks associated with installation and operation.
Products should never be exposed to freezing temperatures or allowed to run dry for extended periods.
Determining product suitability for any specific application is solely the responsibility of the purchaser.
Sales & Use Tax Policy
We have prepared this Sales & Use Tax Policy to explain when and why sales tax may be collected.
Important Notice
Even if WaterSticks does not collect sales tax on your purchase, you may still owe sales or use tax to your state.
Unless you reside in Alaska, Delaware, Montana, New Hampshire, or Oregon, your state may require you to report and pay applicable use tax directly.

Arbitration & Class Action Waiver

Judgment on the arbitration award may be entered in any court having jurisdiction.
Nothing in this section prevents either party from seeking temporary injunctive relief or pursuing claims in small claims court where permitted by law.
If a court determines that this class action waiver is unenforceable, only that portion shall be severed, and the remainder of this arbitration provision shall remain in effect.
Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
Entire Agreement
These Terms & Conditions, together with our Privacy Policy, Sales & Use Tax Policy, Warranty Policy, Return Policy, Shipping Policy, and any additional policies posted on our website, constitute the entire agreement between WaterSticks Inc. and the customer regarding the use of our website and purchase of our products.
